Welcome to Polo App, a peer-to-peer marketplace designed for users to buy and sell goods and services. By accessing or using Polo App (the "App") or any of our services (the "Services"), you agree to be bound by these Terms of Service (the "Terms").
If you do not agree to these Terms, do not use the App or the Services. We may update these Terms from time to time, and any changes will be effective when posted in the App or on our website. Please check these Terms periodically for any updates.
1. Use of the App
To use the App, you must comply with all applicable local, state, and federal laws of Illinois. You must provide accurate and complete registration information, including your name, phone number, email address, profile picture, and payment information.
You are responsible for maintaining the confidentiality of your account credentials and agree to notify us immediately of any unauthorized use of your account.
2. Marketplace Rules
Eligibility: The App is intended for users to buy and sell goods and services. Users must provide valid payment details.
Listings: You may list items or services for sale on the App, subject to compliance with our guidelines. All listings must be legal and must not violate the rights of any third party.
Transactions: Polo App serves as a platform to facilitate transactions between buyers and sellers. We are not a party to the actual transaction and are not responsible for any issues related to the quality, condition, or legality of the items or services sold.
Payment and Fees: Buyers will be charged the agreed purchase price, including applicable taxes and fees, at checkout. Sellers are responsible for any fees associated with listing or selling, as detailed in the App.
Prohibited Items: You may not use the App to sell illegal, counterfeit, or prohibited items or services. We reserve the right to remove any listings that violate these policies.
3. Seller Obligations
Sellers must be honest and transparent about the goods or services they are selling. This includes providing accurate descriptions, disclosing any defects or limitations, and setting fair prices.
Delivery: Sellers are responsible for delivering the item or providing the service as agreed upon with the buyer. If there are delays or issues, sellers must notify the buyer and Polo App as soon as possible.
Refunds and Returns: Sellers must handle all returns or refund requests in accordance with our Refund Policy. Buyers are encouraged to contact the seller first if there are issues with their order.
4. Buyer Obligations
Buyers must be completely honest and transparent about what they are buying and how they receive it. This includes providing accurate information about their intended use of the item or service and their ability to pay.
Payment: Buyers must pay for items or services in full, including applicable taxes and fees, at the time of purchase through the App.
Receiving Goods or Services: Buyers are responsible for receiving the items or services they purchase and checking their condition or quality upon delivery or completion.
5. Privacy and Data Protection
We collect and process personal information as described in our Privacy Policy. By using the App, you agree to our Privacy Policy, which can be found on our website.
6. Dispute Resolution
In the event of a dispute between a buyer and a seller, we encourage both parties to resolve the issue amicably. If a resolution cannot be reached, please contact our customer support team, and we will work to mediate the issue.
7. Termination and Suspension of Accounts
We reserve the right to suspend or terminate your account at any time, without notice, if we determine that you have violated these Terms or engaged in fraudulent or unlawful activities.
8. Intellectual Property
All content, trademarks, logos, and intellectual property related to the App are owned by Polo App or its licensors. You may not use or reproduce any of these without our express written consent.
9. Limitations of Liability
To the maximum extent permitted by law, Polo App and its affiliates are not liable for any damages, losses, or liabilities arising from your use of the App, including but not limited to product defects, non-delivery of goods or services, fraud, or disputes between users.
10. Indemnity
You agree to indemnify and hold harmless Polo App, its affiliates, and its officers, directors, employees, and agents from any claim, damage, loss, or expense arising from your use of the App, violation of these Terms, or infringement of any third-party rights.
11. Governing Law
These Terms will be governed by and construed in accordance with the laws of the State of Illinois without regard to its conflict of law principles. Any disputes will be resolved in the competent courts located in Illinois.
12. Miscellaneous
Entire Agreement: These Terms constitute the entire agreement between you and Polo App regarding your use of the App and supersede all prior agreements or understandings.
Severability: If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.
Assignment: Polo App may assign or transfer its rights and obligations under these Terms at any time.
